Terms of Service

These Terms are an agreement between you and Deivis Jankauskas, operating Gaspr as a trading name ("Gaspr", "we", "us"). By creating an account or using the Gaspr app, you agree to them. If you don't agree, please don't use the app.

A few in-game words used below:

• House — a group you play in.
• Haunt — a round of play.
• Response — an answer you submit to a prompt.
• Gasp — a vote you cast, and the in-app points/currency you earn from votes.
• Ghost — your in-app avatar.

1. Who can use Gaspr

You must be at least 16 years old to use Gaspr. Date of birth is mandatory during signup, and Gaspr may refuse or end account creation if the date of birth shows you are under 16.

You must provide an accurate date of birth. Giving a false date of birth, trying to bypass the age gate, or helping someone else bypass it is a breach of these Terms.

If you are under 16, you must not create an account or use Gaspr.

2. Your account

You sign up with an email address or supported provider login and play under a generated pseudonym. You're responsible for keeping your login secure and for activity on your account. Let us know promptly if you think your account has been compromised.

You may not create accounts to manipulate the game — for example, running multiple accounts to inflate votes or scores (see §7).

3. Licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use Gaspr on devices you own or control, for your own non-commercial enjoyment, subject to these Terms. We keep all rights not expressly granted. You may not copy, modify, reverse-engineer, resell, or attempt to extract the source of the app, except where the law says you can't be stopped from doing so.

4. Your content

You keep ownership of the Responses, votes, reports, feedback, and other content you create in Gaspr ("Your Content"). By posting Your Content, you grant us a worldwide, royalty-free, perpetual, non-exclusive licence to host, store, reproduce, display, distribute, adapt, create derivative works from, and otherwise use Your Content:

• to operate, secure, moderate, and improve Gaspr;
• to show Your Content inside the app, including to members of your House and in round history/results;
• to review reports, enforce these Terms, and keep safety or legal evidence where needed;
• to feature, promote, advertise, and market Gaspr on owned, paid, social media, app-store/listing, website, press, and other promotional channels.

This licence is sublicensable where needed for service providers and platforms that help us operate or promote Gaspr, such as hosting, app stores, social platforms, creative tools, and advertising partners.

Marketing use is anonymised by default. Gaspr may feature or promote in-game Responses without individual attribution. MVP marketing attribution is anonymous only; if optional credit is introduced later, it may use only your generated Gaspr display name, not a personal/legal name.

Only content from users who have verified they meet the age requirement is eligible for UGC/marketing use.

You can request removal of content that has been used in marketing after publication by using the in-app Contact Us route or contacting support@gaspr.io. We will remove or request takedown from channels we control where practical, but already-shared material may persist outside our control.

You're responsible for Your Content. You confirm that you have the right to post it and that it doesn't break these Terms or our Community Guidelines.

5. Community standards

Gaspr is a comedy app, and dark or edgy humour is welcome — but there are lines. You agree to follow our Community Guidelines, which form part of these Terms. In short: be funny, not cruel; no harassment, hate, threats, sexual content involving minors, doxxing, or illegal content.

You can block another player so you no longer see their content, and you can report content. Reported content may be hidden from a House while we review it.

6. Content removal and moderation

We may remove, hide, restrict, or preserve content where we reasonably think it breaks these Terms, the Community Guidelines, the law, app-store rules, or another person's rights. Moderation records and evidence may be retained even if content is no longer visible to players.

We may also refuse to use, stop using, or remove content from marketing if it becomes unsafe, ineligible, disputed, reported, or unsuitable.

7. Fair play

To keep the game fair, you must not:

• use bots, scripts, or automation to play, vote, or earn Gasps;
• run multiple accounts, or coordinate with others, to manipulate votes, scores, or standings ("vote farming");
• exploit bugs for advantage instead of reporting them;
• interfere with the app's servers, security, or other users' experience;
• bypass signup, age-gating, moderation, or eligibility controls.

We design parts of the game (such as group-size limits) partly to keep this in check, and we may take action — up to suspending or terminating accounts — against anyone who breaks these rules.

8. Gasps, points, and virtual items

Gaspr includes in-app points and virtual items, surfaced as Gasps and cosmetic items for your Ghost.

• Gasps and points have no monetary value. They are not money, they are not your property, and they can't be exchanged, transferred, sold, or cashed out for anything outside the app.
• Your standing (the recognition you earn from votes) is earned through play and can't be bought. Where the app sells cosmetic items, those items don't change your standing — status is earned, not bought.
• We may change, suspend, or remove Gasps, points, virtual items, or game features at any time, including for balance, safety, or technical reasons. Where we do this in a way that materially affects items you've paid for, we'll act reasonably and in line with your legal rights.
• You have no expectation of a refund for Gasps or virtual items earned or held in the app, except where the law requires one.

9. In-app purchases (where available)

If and when Gaspr offers paid items, purchases are processed by the relevant app store (Apple App Store or Google Play), not by us, under that store's terms. We never see or store your payment-card details.

Refunds for purchases are handled under the app store's policies and your statutory consumer rights. If you're a UK consumer, nothing in these Terms removes rights you have under the Consumer Rights Act 2015 or other consumer-protection law.

10. Changes to the app and these Terms

We're actively developing Gaspr and may add, change, or remove features. We may also update these Terms; if a change is significant, we'll notify you in the app or by email. Continuing to use Gaspr after a change means you accept the updated Terms.

11. Suspension and termination

You can stop using Gaspr and delete your account at any time. We may suspend or terminate your access if you break these Terms or the Community Guidelines, if you are under 16, if you bypass age-gating, or where we reasonably need to for safety, legal, app-store, or technical reasons. Some provisions — including those on content licence, virtual items, liability, governing law, and safety/audit records — survive termination.

12. Disclaimers

Gaspr is provided "as is" and "as available". We don't promise it will be uninterrupted, error-free, or that it will always be available. To the extent the law allows, we exclude implied warranties. This doesn't affect any rights you have as a consumer that can't legally be excluded.

13. Limitation of liability

To the fullest extent permitted by law, we won't be liable for indirect or consequential losses, or for loss of data, profit, or goodwill arising from your use of Gaspr. Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that can't legally be limited. If you're a consumer, your statutory rights are unaffected.

14. Apple and Google terms

If you downloaded Gaspr from the Apple App Store: these Terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the app. Apple isn't responsible for any product claims, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you. You confirm you're not in a country subject to a US embargo or on a US prohibited-parties list.

If you downloaded it from Google Play, Google's terms also apply to your download and use.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except that if you're a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
